Overview: Slave named Lydia misbehaving, tried to run away, he shot her, Mann was fined Ten dollars.

State:

-it was assault; any punishment that is inhumane, cruel and unusual punishment.

-NC deemed his response inappropriate, charged with assault and battery

-Slave=rented

-technically not his slave

-legally belonged to Elizabeth Jones

-Damaged to another's property, Lydia was not property of John Mann

-Vandalism

-Mann's action didn't cause happiness to anyone

-State vs hill: committed personal violence on slave by striking him, he was found guilty

-harm of slave is punishable by law

Mann

-Mann owned Lydia for a year, still property, therefore could do anything at the time he owned her.

-Illegal for Lydia to run away, so he could punish her.

-3/5 compromise

-Running north can be punished

-Slaves were made property

-ethically saving slave, bc bounty hunters, she didn't die, could've had much more severe punishment
